Vacancy: LEGAL & INDUSTRIAL RELATIONS SERVICES MANAGER

Agricultural Employers Association commonly known as AEA was started in 1962 and registered in 1966 under the Trade Union’s Act Cap 233 as an Association representing the collective interests of employers in the Agricultural industry in matters connected with Employment of Labour.

We are seeking to engage a passionate and result oriented professional to fill the following vacancy that has arisen:

Vacancy: LEGAL & INDUSTRIAL RELATIONS SERVICES MANAGER

Reporting to the CEO, the LEGAL & INDUSTRIAL RELATIONS SERVICES MANAGER will be responsible for provision of Legal advice, Legal compliance, Management of grievances and disputes, CBA negotiations, representation in both Tribunal and Labour and Employment Courts, documentation of policies and procedures, resolving any Employment Relations issues and facilitation of trainings.

KEY RESPONSIBILITIES

 

  • Represent members in ELRC matters within the jurisdiction of the Courts of Kenya.
  • Chair CBA negotiation meetings between employers and union.
  • Carry out HR and legal Compliance audit in the member farms and provide conclusive reports to the relevant authorities.
  • Liaise with members’ legal departments to resolve or handle matters as required by the association's mandate.
  • Draft and implement Legal documents as required.
  • Securing injunctive orders whenever required.
  • Give advisory services to members on call or email on any emerging issues related to labor and provide sufficient progress reports for the same.
  • Represent members in Conciliation/ Trade disputes.
  • Conflict resolution i.e during strikes and any other conflicts that arise.
  • Handle Grievances and Discipline issues.
  • Manage consultative meetings at the farm level between union and members.
  • Training and Development facilitation
  • Ability to negotiate, conclude and prepare collective bargaining agreements for registration
  • Monitoring and reporting on changes in the legislation that directly impact the organization and its members.
  • Ensuring the organization and its members stay up to date with statutory requirements.
  • Perform other duties as required.

 

QUALIFICATION AND EXPERIENCE

 

  • Bachelors of Law Degree. Masters Degree would be an added advantage.
  • Kenya School of Law; Post Graduate Diploma in Law
  • Diploma in Human Resource Management or CHRP will be an added advantage.
  • Member in good standing LSK/IHRM.
  • Advocate of the high Court of Kenya.
  • Minimum 7 years’ relevant experience in handling cases at ELRC & Magistrates Court
  • Deep understanding of employment laws, policies and procedures and labor structures in the country.
  • Certified Mediator or Arbitration professional an added advantage.
  • Knowledge of ADR principles and methods
